Donation Terms & Conditions

Burnt Orange Club (“Company,” “we,” “us,” or “our”) offers products under the “Foundation” line with the intent of donating a portion of proceeds to benefit students, clubs, and school organizations. By purchasing Foundation products, you (“Customer,” “you,” or “your”) agree to the following terms and conditions:

Donation Commitment

  • Burnt Orange Club commits to donating 50% of profits generated from the sale of Foundation products.

  • Profits are defined as gross revenue received from sales of Foundation products minus costs associated with production, fulfillment, shipping, transaction fees, and any other expenses reasonably incurred.

  • Donations will be made annually, within ninety (90) days following the end of each calendar year.

Eligibility & Minimum Threshold

  • To qualify for a donation, the total designated donation amount must reach a minimum of $1,500 within the calendar year.

  • If the minimum threshold is not reached, Burnt Orange Club is under no obligation to disburse funds.

  • Eligible recipients include individual students, officially recognized school clubs, and school-based organizations.

  • Proof of enrollment, recognition, or status may be required before any funds are awarded.

Selection of Recipients

  • Recipients will be selected at the sole discretion of Burnt Orange Club.

  • Selection may consider but is not limited to: need, impact, alignment with the Company’s values, and demonstrated involvement in the school or community.

  • Burnt Orange Club reserves the right to withhold, delay, or redirect funds if recipient eligibility cannot be verified.

Exclusions & Exceptions

  • Donations will not be awarded to political organizations, religious groups (unless funds are used strictly for non-religious educational purposes), or entities outside of the United States.

  • Donations may not be used for purposes inconsistent with federal, state, or local laws.

  • If misuse of funds is discovered, Burnt Orange Club reserves the right to demand repayment or withhold future participation.

Administrative Rights

  • Burnt Orange Club reserves the right to:

    • Modify, suspend, or terminate the Foundation program at any time without prior notice.

    • Adjust timelines, amounts, or recipient selection processes at its discretion.

    • Withhold donations if fraud, misrepresentation, or ineligibility is suspected.

Legal Disclaimer

  • Nothing in this program creates a partnership, employment, or agency relationship between Burnt Orange Club and any student, club, or organization.

  • Burnt Orange Club makes no guarantee of donation amounts in any given year.

  • Customers’ purchase of Foundation products does not entitle them to a tax deduction. Donations are made solely by Burnt Orange Club and are not tax-deductible by the purchaser.

  • Burnt Orange Club is not responsible for any disputes, claims, or liabilities that may arise once funds are awarded.

Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of Travis County, Texas.
